Welcome to AI Video : Photo & Video Maker (the "App"). These Terms of Service ("Terms") constitute a legally binding agreement between you and us ("we," "us," or "our") regarding your access to and use of our mobile application and related services.
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App and should uninstall it immediately.
The App is an AI-powered creative platform that enables users to generate, edit, and enhance video and image content using advanced artificial intelligence technology.
· 2.1 Core Features: The App provides tools for AI video generation, style transfer, template-based visual effects, and photo enhancement.
· 2.2 Paid Features and Subscriptions: The App may offer paid subscriptions, in-app purchases, or other paid features. Prices, billing periods, included benefits, renewal terms, and any available trial offers will be displayed in the App or on the applicable app store purchase page before you complete a purchase.
· 2.3 Billing and Subscription Management: Access to certain AI generation features may require payment. Subscription billing, renewals, cancellations, and refunds are handled according to the terms and policies of the applicable app store or payment provider.
· 2.4 AI Nature: You acknowledge that the content generated by the App is produced by AI models. The quality, accuracy, and consistency of the output may vary and are subject to the technical capabilities of our third-party AI providers.
· 3.1 Age Requirement: You must be at least 13 years old (or 16 in the EU/UK) to use the App.
· 3.2 Parental Consent: If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that you have obtained the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
· 4.1 No Registration Required: To protect your privacy, the App does not require account registration. No email address, phone number, or password is collected.
· 4.2 Device-Bound Data: Your usage history and App preferences are associated with a unique, randomly generated anonymous identifier tied to your device.
· 4.3 No Account Recovery: Because accounts are anonymous and device-bound, if you delete the App, reset your device, or lose your device, your data—including generated content—may be permanently lost. We cannot recover data for anonymous accounts.
· 5.1 Ownership: You retain all rights, title, and interest in and to the original photos and videos you upload to the App ("User Content"). We do not claim ownership of your User Content.
· 5.2 License for Service: By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, and temporarily store your content solely for the purpose of providing the App’s generation services.
· 5.3 AI Providers: You acknowledge and agree that your User Content will be processed by our trusted third-party AI partners, specifically OpenAI and Volcengine .
· 5.4 No AI Training: We strictly prohibit the use of your User Content for training, improving, or fine-tuning AI models.
· 5.5 Temporary Storage: All uploaded User Content and generated outputs are temporarily hosted on secure Amazon Web Services (AWS) servers.
· 5.6 Automatic Deletion: To ensure data privacy, all User Content and generated assets are automatically and permanently deleted from our servers after 180 days.
· 5.7 User Consent: Before using AI features, users will be presented with a clear in-app consent prompt. Users must explicitly agree before any data is transmitted to third-party AI service providers.
· 6.1 App Intellectual Property: The App, including its UI, design, code, graphics, branding, and algorithms, is our exclusive property and is protected by intellectual property laws.
· 6.2 AI-Generated Content: Legal ownership and copyright status of AI-generated content vary by jurisdiction. We do not claim ownership of content generated through your use of the App. You are solely responsible for how you distribute or publish AI-generated content.
You agree to use the App in compliance with all applicable laws and the following guidelines. You may NOT:
· Generate content that is illegal, harmful, threatening, abusive, defamatory, or obscene.
· Generate non-consensual intimate imagery or "deepfakes" of real individuals.
· Infringe upon the intellectual property or privacy rights of any third party.
· Access the App through unauthorized automated means (bots, scripts, etc.).
· Reverse engineer, decompile, or attempt to derive the source code of the App.
We rely on third-party services, including but not limited to AWS (storage), OpenAI (AI models), and Volcengine (AI technology). Your use of the App is also subject to the acceptable use policies of these providers. We are not responsible for service outages or changes in policy by these third parties.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
· We do not warrant that the App will be uninterrupted, error-free, or secure.
· We do not warrant the quality, accuracy, or suitability of any AI-generated output.
· You use the App and its generated content at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR PROFITS. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED FIFTY US DOLLARS ($50.00).
You agree to indemnify and hold harmless us and our affiliates from any claims, damages, or expenses arising out of your use of the App, your User Content, or your violation of these Terms.
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, if we believe you have violated these Terms or are using the App in a manner harmful to others.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
